Terms of Service

1. Acceptance of Terms

By accessing or using HireStaq ("the Service"), operated by Revivesoft LLC ("Company," "we," "us," or "our"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately cease use of the Service. These Terms constitute a legally binding agreement between you and Revivesoft LLC.

By checking a registration checkbox, clicking "Sign Up," or otherwise accessing the Service, you represent that you have read, understood, and agreed to these Terms and our Privacy Policy.

2. Description of Service

HireStaq is a web-based AI-powered resume optimization platform that enables users to analyze resumes against job descriptions, identify gaps, generate improvement suggestions, edit resumes using a structured workflow, maintain a work journal, generate cover letters, and export finalized documents. The Service is provided "as is" and may be modified, suspended, or discontinued at any time.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the accuracy of your account information
• Keep your password confidential and not share it with any third party
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to terminate accounts, remove content, or refuse service at our sole discretion. You may not create multiple accounts to circumvent plan limits or restrictions.

5. User Content

You retain ownership of all content you upload or create through the Service, including resumes, job descriptions, journal entries, and other documents ("User Content").

By using the Service, you grant Revivesoft LLC a limited, non-exclusive, royalty-free, worldwide license to process, store, reproduce, and transmit your User Content solely as necessary to provide the Service to you. This license terminates when you delete the content or close your account.

You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe any third-party intellectual property, privacy, or other rights; and (c) your User Content is truthful and not fraudulent or misleading.

Feedback: If you submit feedback, ideas, or suggestions about the Service, you grant us an irrevocable, perpetual, royalty-free license to use and incorporate such feedback without obligation or compensation to you.

6. AI-Generated Content and Scores

The Service uses third-party AI models (including OpenAI and Anthropic) to generate analysis, suggestions, optimizations, compatibility scores, ATS (Applicant Tracking System) compatibility assessments, STAR bullet scoring, and cover letters (collectively, "AI-Generated Content"). All results, scores, analysis, and recommendations provided by the Service are entirely AI-driven.

• AI-Generated Content is provided as suggestions only and does not constitute professional career advice, employment guidance, or any form of professional recommendation.
• You are solely responsible for reviewing, editing, verifying, and using AI-Generated Content. You should independently verify all information before relying on it.
• We make no warranty that AI-Generated Content is accurate, complete, appropriate, error-free, or suitable for any particular purpose, employer, or applicant tracking system.
• ATS compatibility scores, keyword analysis, and compatibility assessments are AI-generated estimates only. They do not reflect the behavior of any specific applicant tracking system, employer screening process, or hiring workflow. Actual ATS systems vary widely in their parsing and scoring logic, and our scores bear no guaranteed correlation to how any real ATS will process your resume. We accept no responsibility for the accuracy of these scores or any reliance placed upon them.
• STAR bullet scores and gap analysis are AI-generated assessments only. They represent the AI model's interpretation and may not reflect how an employer or recruiter would evaluate your resume content.
• We are not liable for any consequences resulting from your use of AI-Generated Content, including but not limited to rejection by employers, misrepresentation on resumes, missed opportunities, or any other harm or damage of any kind.
• You must not knowingly include false or fabricated information in your resume, even if AI-generated. You bear full responsibility for the truthfulness of your final resume content.

REVIVESOFT LLC ACCEPTS NO RESPONSIBILITY WHATSOEVER FOR THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT, SCORES, ANALYSIS, OR RECOMMENDATIONS. All AI outputs are provided on an "as is" basis without any warranty. Your use of AI-Generated Content is entirely at your own risk.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Upload content that is false, fraudulent, defamatory, obscene, or violates any third party's rights
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Interfere with, disrupt, or degrade the performance of the Service
• Use automated scripts, bots, or scrapers to access the Service without prior written permission
• Circumvent, bypass, or defeat any rate limits, usage restrictions, or access controls
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or provide access to the Service to third parties without authorization
• Use the Service to develop competing products or services
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or any harmful code

Violation of these restrictions may result in immediate termination of your account and may subject you to legal liability.

8. Subscription, Payments, and Refunds

Certain features require a paid subscription. By subscribing, you agree to the following:

• Payments are processed by LemonSqueezy, our third-party payment processor.
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• You may cancel your subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period.
• We reserve the right to modify pricing with at least 14 days' advance notice to existing subscribers.
• Refunds are not provided for partial billing periods or unused features, except where required by applicable law.
• We reserve the right to modify, limit, or discontinue plan features with reasonable notice.

If you believe you have been charged in error, contact us at support@hirestaq.com within 30 days of the charge.

9. Intellectual Property

All content, features, software, designs, trademarks, and technology comprising the Service (excluding User Content) are owned by Revivesoft LLC or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

"HireStaq" and the HireStaq logo are trademarks of Revivesoft LLC. Unauthorized use is prohibited.

10. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted or error-free access to the Service. We may, at our sole discretion:

• Modify, suspend, or discontinue any feature or the entire Service, with or without notice
• Perform maintenance or updates that temporarily affect availability
• Change plan features, usage limits, or AI models used

We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Revivesoft LLC disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the Service will be uninterrupted, timely, secure, or error-free
• Any warranty regarding the accuracy, reliability, or completeness of any AI-generated content, analysis, scores, ATS compatibility assessments, or recommendations
• Any warranty that using the Service will result in employment, interviews, or any particular career outcome

Your use of the Service is at your sole risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REVIVESOFT LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from your reliance on AI-generated content, scores, ATS assessments, or recommendations
• Damages resulting from unauthorized access to your account
• Damages from service interruptions, data loss, or security breaches

Our total cumulative liability to you for any claims arising from or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow limitation or exclusion of certain warranties or liabilities; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Revivesoft LLC and its officers, directors, members, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your violation of any applicable law or regulation

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. You may delete your account at any time via the Service settings or by contacting us.

Upon termination: (a) your right to use the Service ceases immediately; (b) we may delete your data in accordance with our Privacy Policy; (c) provisions that by their nature should survive termination (including Sections 5, 9, 11, 12, 13, 15, and 16) shall survive.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution: Before initiating any formal dispute, you agree to contact us at support@hirestaq.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class-action lawsuits or class-wide arbitration.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

If you are a consumer in the EU or UK, mandatory consumer protection laws of your country of residence may also apply.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service with a revised "Last updated" date and, where practicable, by email notification. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.

18. General Provisions

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Revivesoft LLC regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that right.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or acquirer.
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, or third-party service failures.
• No Employment Relationship: Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Revivesoft LLC.
• Notices: Notices to us must be sent to support@hirestaq.com. We may send notices to your registered email address.
